Terms of Service

These terms apply to your use of fairkost.com and its tools (the "site"), operated by Fairkost LLC, doing business as Fairkost Real Estate ("Fairkost," "we," "us"), a licensed real estate brokerage in Tennessee. By using the site, you agree to these terms. If you don't agree, please don't use the site.
1. Using the site doesn't create an agency relationship
Using the site, filling out a form, or using a tool on it does not make Fairkost your real estate agent or broker. An agency relationship begins only when you sign a written agreement with Fairkost, such as a listing agreement or buyer agreement. Until then, we don't represent you, and you shouldn't share information you want kept confidential.
2. Commissions and fees
Real estate commissions and fees are negotiable and are not set by law. Our packages, fees, and their terms are described on our Pricing page and in the written agreement you sign. If the site and your signed agreement differ, the signed agreement controls.
3. Information on the site
We work to keep the site accurate, but we don't guarantee it. Listing information comes from multiple listing services, public records, and other sources, is deemed reliable but not guaranteed, and may change or be withdrawn at any time. Verify any information that matters to you, such as square footage, school zones, taxes, and HOA rules, with the appropriate source.
Our guides and articles are general information. They are not legal, tax, financial, or investment advice. Talk with a qualified professional about your situation.
4. Estimates and calculators
The savings calculator and any other estimates on the site are examples based on the numbers you enter and on assumptions we state. They are not a promise of any sale price, savings, timeline, or result. Your actual costs and results depend on your agreement, your property, and the market.
5. Buyer list and agent matching
When you request a list of homes, our team selects homes we think fit what you've told us. We don't promise that any home will be available or right for you. When you ask us to match you with a partner agent, matches depend on availability in our partner network, and we can't promise a match in every area. A partner agent may be with another brokerage, and Fairkost may receive a referral fee from that brokerage.
6. Make an offer (letters of intent)
The Make an offer tool helps you outline terms you might propose for a home. A letter it creates is not binding, is not an offer or a contract, and is not legal advice. Nothing is sent to a seller or their agent until a Fairkost agent reviews it with you and you approve it. A binding agreement exists only when buyer and seller sign a written purchase and sale agreement.
7. Cash offers
Cash offers are not guaranteed. Offer amounts depend on the home's condition, location, and market, and may be less than the home could sell for on the open market. Cash offers may come from third-party buyers or from Fairkost, its owners, licensees, or affiliated companies. If the buyer is a Fairkost licensee or affiliated company, we'll tell you in writing before you sign anything, and the buyer will not be acting as your agent.
8. Calls, texts, and emails
If you give us your phone number and check the box agreeing to texts, you agree that Fairkost may call and text you at that number, including by automated means. Consent is not a condition of any purchase. Message and data rates may apply, and message frequency varies. Reply STOP to opt out of texts. Reply HELP or call (865) 398-2609 for help. See our SMS Terms. You can unsubscribe from marketing emails at any time using the link in any email. See our Privacy Policy for how we use your information.
9. Accounts
Some parts of the site require an account. Keep your login details private, and tell us right away if you think someone has used your account without permission. We may suspend or end access to an account that breaks these terms.
10. Acceptable use
Don't:
- Use the site for anything unlawful, including discrimination prohibited by fair housing laws.
- Submit false information or someone else's information without permission.
- Copy, scrape, or republish listing data or site content, except for your own personal, non-commercial use.
- Try to access parts of the site or data you aren't allowed to access, or interfere with how the site works.
11. Our content
The site's text, design, logos, and other content belong to Fairkost or the people who licensed them to us. Listing photos and data belong to their owners and are used under license. You may view and share pages for personal use, but don't copy or use our content commercially without written permission.
12. Links to other sites
The site may link to websites we don't control. We aren't responsible for their content or practices.
13. Fair housing
Fairkost follows federal and Tennessee fair housing laws. We don't discriminate based on race, color, religion, sex, disability, familial status, national origin, or any other characteristic protected by law.
14. Disclaimers
The site is provided "as is" and "as available." To the fullest extent the law allows, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don't promise that the site will be uninterrupted or error-free.
15. Limitation of liability
To the fullest extent the law allows, Fairkost and its owners, licensees, and staff are not liable for any indirect, incidental, special, or consequential damages arising from your use of the site. Our total liability for any claim about the site is limited to $100. This section doesn't limit any duties we owe you under a signed brokerage agreement or under Tennessee real estate license law.
16. Indemnity
If you use the site in a way that breaks these terms or the law, and someone brings a claim against Fairkost because of it, you agree to cover the reasonable costs of that claim, including attorney's fees.
17. Governing law
Tennessee law governs these terms. Any dispute about the site will be handled in the state or federal courts located in Knox County, Tennessee.
18. Changes to these terms
We may update these terms. When we do, we'll change the effective date above and post the new version on this page. Continuing to use the site after a change means you accept the updated terms.
